GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale apply to all bookings made at one of the hotels in the LANGLEY HOTELS & RESORTS group by any customer.
The terms used throughout these General Terms and Conditions of Sale and indicated by a capital letter are defined as follows:

Customer(s):
An individual making a booking for personal, professional, artistic, agricultural, liberal, industrial, or commercial needs, other than those related to the hotel industry.

Hotel(s):
The hotel(s) of the LANGLEY HOTELS & RESORTS group.

Service(s):
All hotel services offered by the Hotel(s) of the LANGLEY HOTELS & RESORTS group.

The Website:
The website of the LANGLEY HOTELS & RESORTS group accessible via the link www.langleyhotels.eu.

Terms of Sale for the Reserved Rate:
Specific conditions applicable to the booking made by the Customer.

Group Booking:
A booking of more than 10 hotel rooms.

Booking Confirmation:
An email sent by the selected hotel containing all the essential information about the booking made by the Customer and confirming acceptance of the booking.

Introduction

  • These General Terms and Conditions aim to define the terms and conditions under which the LANGLEY HOTELS & RESORTS group allows its Customers to benefit from the Services offered by its Hotels. By making a booking or using the Hotel’s Services, the Customer acknowledges having read, understood, and unreservedly accepted these General Terms and Conditions.

  • The LANGLEY HOTELS & RESORTS Group has a dedicated hotel booking website (www.langleyhotels.eu) where all hotels operated by the group can be booked. This site allows Customers to book rooms and various hotel services within the Group's different hotels.

  • The LANGLEY HOTELS & RESORTS Group’s website provides all necessary information to the Customer:
    • The contact details of the LANGLEY HOTELS & RESORT group, accessible in the "Privacy Policy" section.
    • The email address and phone numbers of each Hotel within the Group, as well as the parent company LANGLEY HOTELS & RESORTS.
    • Essential features of the rooms and hotel services offered to the Customer.
    • The full VAT-inclusive prices for rooms and hotel services offered by the Hotels.
    • Payment methods.
    • These General Terms and Conditions of Sale, as well as specific or "special" conditions and group booking conditions.
    • The content and duration of offers proposed by the Hotels, as well as the duration of the contract concluded between the Customer and the selected Hotel.
    • Contact addresses.

The information provided on the Website is available in French and English.

  1. Purpose
  • Only Customers of legal age may make a booking at the selected hotel.
  • These General Terms and Conditions of Sale aim to define the respective rights and obligations of the Customer and the LANGLEY HOTELS & RESORTS group for all bookings of accommodation and/or additional or optional hotel services offered by the Hotels.
  • These provisions apply to the entire booking process and its follow-up between the contracting parties.
  1. Booking

Each Customer freely selects the Hotel that best suits their needs and the required hotel services offered by the LANGLEY HOTELS & RESORTS.

  • The Customer has several means of booking their stay: bookings can be made on the Website, via the phone number of the selected Hotel, or at the Reception of any Hotel within the Group.
  • The Website allows Customers to book their stay online and add additional or optional services. Group conditions may apply for bookings of multiple rooms.
  • The rooms offered on the Website are accompanied by an information sheet specific to each room and each Hotel, providing details on:
    • The essential features of the room and Services offered.
    • The price or any benefit linked to or compensating for the payment (discounts, combining the room with breakfast, last-minute offers, etc.).
    • Payment terms and conditions.
    • The special terms of sale, cancellation, and modification applicable to the booking.
    • Ancillary services included in the offer.
    • These General Terms and Conditions of Sale.
    • Special conditions specifically applicable to the room.

The responsibility of the LANGLEY HOTELS & RESORTS group cannot be sought for the Customer’s choice of rooms and services.

  • Any booking on the Website takes place after the Customer reads and accepts without reservation these General Terms and Conditions of Sale by checking the icon: "I acknowledge that I have read and accept the general terms and conditions of sale." The General Terms and Conditions of Sale applicable to the Customer are those in effect on the date of booking.

  • By checking the icon: "I acknowledge that I have read and accept the general terms and conditions of sale," the Customer acknowledges having read and accepted these General Terms and Conditions of Sale before proceeding with the booking.

  • A booking is deemed accepted by the Customer upon completion of the booking process, after the Customer has accepted the general terms of sale and any special terms applicable to each room or specific booking, as well as group conditions if applicable.

  • All bookings are nominative and may not be transferred to a third party. The booking must be made in the name of the stay holder and must indicate the names, first names, and number of people occupying the reserved room(s).

The Customer agrees to provide truthful and accurate information to the Hotel during booking, including mandatory personal data. Any incomplete, inaccurate, or fraudulent booking or any booking that does not comply with these General Terms and Conditions of Sale or legal provisions may be canceled or not registered by the LANGLEY HOTELS & RESORTS group without compensation to the Customer.

  • The processing of the booking requires the Customer to provide mandatory personal data, such as:
    • The Customer's first and last names.
    • The Customer's age.
    • The number of people occupying the reserved room and the identity document (or residence permit) of the stay holder and room occupants.
    • The age of accompanying individuals.
    • Any minor aged 0 to 2 years is considered a baby, minors aged 2 to 18 years are considered children, and adults are considered individuals over 18 years old.
  1. The Booking Process
  1. Selection of the Hotel and room offering the most suitable services to the Customer among the Hotels proposed by the LANGLEY HOTELS & RESORTS group, selection of arrival and departure dates, and the room rate.
  2. Selection of the hotel services offered by the selected Hotel and their rates.
  3. Review of the booking details and its total price.
  4. The Customer provides their contact details.
  5. The Customer enters their banking details to proceed with payment.
  6. By checking the box: "I acknowledge that I have read and accept these General Terms and Conditions of Sale as well as the Special Terms of Sale applicable to the reserved room, and where applicable, the Group Conditions," the Customer confirms having read and accepted these terms before finalizing their booking. Any booking constitutes full acceptance of said conditions.
  7. The Customer confirms and validates the booking and payment.
  1. Booking Receipt

The Hotel sends a Booking Confirmation email containing the essential information of the reservation (stay dates, booking number, summary of services, and the general and special terms of sale accepted by the Customer) as well as the contact email address for any complaints. This confirmation email constitutes the Hotel's acceptance of the booking, making it final.

  1. Change or Cancellation of Booking by the Customer

According to Article L221-28 12°) of the French Consumer Code, the Customer does not have the right of withdrawal provided for remote sales under Article L221-18 of the Consumer Code, as this concerns accommodation services to be provided on a specific date or period.

  • In accordance with Article 1590 of the French Civil Code, any advance payments are considered deposits. Prepaid bookings cannot be modified or canceled by the Customer and are non-refundable unless the Customer has selected the "cancellation" option during booking. Cancellation or modification of the booking, even in cases of force majeure or due to Covid-19, does not exempt the Customer from payment obligations and will not result in a refund.

  • Similarly, any Customer who has opted for a non-cancellable stay will not receive a refund for the prepaid amount in the event of early departure from the Hotel.
  • If the cancellation option was selected, the Customer may cancel their booking only within the time frame provided by the general and special booking conditions of the room. The reservation will be refunded if the Hotel is notified by email within the specified period.

  • The Customer may review the specific cancellation and modification conditions for the room in the descriptions of commercial offers provided by the Hotels of the Group.
  1. Cancellation by the Hotel

Cancellation Due to Customer Default:

The selected LANGLEY HOTELS & RESORTS Hotel reserves the right to cancel the Customer's booking at any time, with immediate effect, in the following cases:

  • The Customer fails to pay when required.
  • The Customer provides incomplete, inaccurate, or misleading information.
  • The Customer violates any provision of the contract or legal, general, or special terms applicable to the stay.

In such cases, the Customer remains liable for the full cost of the stay as compensation for cancellation fees.

Cancellation for Legitimate Reasons:

The Hotel reserves the right to cancel the Customer's booking for legitimate reasons, such as room unavailability, force majeure, or unforeseen events (e.g., epidemic, natural disaster, strike). The Customer will be notified as soon as possible.

  1. The Stay at the Hotel

The Customer agrees that identity checks and room occupancy conditions, as well as use of other hotel areas, may be conducted by the selected Hotel throughout the stay. By agreeing to these General Terms and Conditions of Sale, the Customer commits to respecting the maximum occupancy per room and refraining from transferring the reservation to anyone else.

  • The Hotels within the Group do not accept minors without the presence of a parent or legal guardian for the entire duration of the stay. French law requires Hotels to have all Customers fill out a police form upon arrival.
  • Upon arrival, Hotels reserve the right to cancel the reservation of any Customer who fails to present a valid identity document or residence permit. No refund will be issued for the stay.
  • By accepting these General Terms and Conditions of Sale, the Customer and their companions agree to comply with the internal rules of the selected LANGLEY HOTELS & RESORTS during the entire stay. In the event of a breach of internal rules, legal provisions, or the general or special terms of sale, the Customer and their companions may be expelled from the hotel without the possibility of a refund.
  • By agreeing to these General Terms and Conditions of Sale, the Customer agrees to use the facilities provided responsibly. Any behavior contrary to French law, public order, applicable safety and hygiene regulations, or good conduct will result in the Customer’s exclusion from the Hotel without a refund.
  • Any damage caused by the Customer or their companions to the room or any other area of the Hotel must be immediately reported to hotel management and will be charged to the Customer.
  • On the scheduled arrival date indicated in the booking confirmation, the Customer must check in at the Hotel Reception before 6:00 PM. The Customer must vacate their room by 12:00 PM (noon) on the scheduled departure date as stated in the booking confirmation. LANGLEY HOTELS & RESORTS reserves the right to charge a late departure fee of at least one additional night.
  • By using the complimentary Wi-Fi network provided by LANGLEY HOTELS & RESORTS, the Customer agrees to refrain from any illegal or fraudulent online activities in compliance with Article L335-2 of the French Intellectual Property Code.
  1. Service Prices

The Customer has access to all prices for hotel services at all LANGLEY HOTELS & RESORTS before and during the booking process via the Group's website, by contacting the specific hotel by phone, or by visiting the Hotel Reception.

  • All essential features of the reservation are included in the price provided: the chosen room, the number of accompanying guests, the selected hotel, and the chosen hotel services.
  • All prices displayed or provided include applicable taxes at the time of booking. However, the tourist tax is not included and must be paid separately by the Customer upon arrival at Reception. The commercial currency for reservations at LANGLEY HOTELS & RESORTS is the Euro.
  • At the time of booking, the Customer is only required to pay the applicable price for the selected hotel services, as well as the tourist tax, which is payable upon arrival.
  • Prices are subject to change at any time at the discretion of the LANGLEY HOTELS & RESORTS group. However, any price changes will not apply to confirmed reservations.
  • Any additional hotel services added by the Customer during their stay will be charged separately and must be paid in full by the end of the stay.
  1. Payment Terms

LANGLEY HOTELS & RESORTS accept payments in cash (with valid ID) and by credit/debit card (Visa, MasterCard, American Express, etc.).

  • For payments made by credit or debit card, the card must remain valid until the Customer's departure date.
  • The Customer must settle all outstanding amounts by the departure date. These amounts include the room rate (which must be paid upon arrival) and any additional hotel services added during the stay.
  • Any unpaid services will be automatically charged to the Customer's bank details provided during booking.
  1. Guarantees

The Hotel reserves the right to request a guarantee before confirming a reservation, such as a security deposit or prepayment.

  • In compliance with Articles L212-1 and following of the French Consumer Code, all Hotels within the LANGLEY HOTELS & RESORTS group guarantee the conformity of all their Services.
  1. Personal Data

French Law No. 2018-493 of June 20, 2018, on personal data protection and the General Data Protection Regulation (GDPR) No. 2016/679, allows the LANGLEY HOTELS & RESORTS group to process the Customer's personal data following their booking for logistical and commercial purposes.

  • Customer data from the Hotels within the LANGLEY HOTELS & RESORTS group is handled with the utmost care and securely, in compliance with the Group's privacy policy, which can be consulted via the link: Privacy Policy.
  • By agreeing to these General Terms and Conditions of Sale, the Customer acknowledges and consents to the presence of video surveillance systems within the Hotels of the LANGLEY HOTELS & RESORTS group. The Customer may exercise their rights of access, rectification, portability, and deletion of their personal data by contacting the Group through:
    • The Group’s email address available on the Website: info.hotels@langley.eu.
    • The email address of the selected Hotel, available in the "Contact" section of the website.
  1. Contract Conclusion

By checking the icon "I acknowledge that I have read and accept the general terms and conditions of sale" and providing their banking details to proceed with payment, the Customer enters into a hotel contract with the LANGLEY HOTELS & RESORTS group.

  1. Applicable Law

These General Terms and Conditions of Sale are governed by the provisions of French law.

  1. Mediation
  • In the event of a claim by the Customer following an incident related to the Hotel’s failure to fulfill its obligations, the Customer is encouraged to communicate it to the Hotel’s Customer Service within 15 days of departure through:
    • Registered mail with acknowledgment of receipt to: 118 Rue Hellbronner, 74402 Chamonix Cedex 3.

If no amicable resolution is reached or no satisfactory response is received within 60 days, the Customer may refer the matter to the Tourism and Travel Mediator through:

  1. Jurisdiction
  • In case of any difficulties encountered by the Customer regarding the interpretation or application of these General Terms and Conditions of Sale, the matter will fall under the jurisdiction of the competent courts in the location of the Hotel's registered office.
